These Terms and Conditions (“Terms”) govern your access to and use of the MahjOn application, website and related services (“Service”) operated by TJAM STUDIOS PRIVATE LIMITED (“TJAM Studios”, “we”, “us” or “our”).
By downloading, registering for, accessing or using MahjOn, you agree to these Terms.
If you do not agree with these Terms, do not use the Service.
1. The Service
MahjOn is a digital Mahjong game using MahjOn gameplay and scoring rules.
The Service may allow users to:
* play against computer-controlled opponents;
* play with invited users;
* participate in games of different round lengths;
* earn virtual Coins;
* purchase virtual Coins;
* receive referral or promotional Coins; and
* use Coins to participate in games and other in-game activities.
Features may change from time to time.
2. Entertainment-Only Virtual Coin System
MahjOn uses a closed-loop virtual currency referred to as “Coins.”
Coins exist solely within the Service.
Coins:
* are not legal tender;
* are not real money;
* are not deposits;
* are not stored-value instruments;
* are not cryptocurrency;
* are not securities or financial products;
* cannot be withdrawn for cash;
* cannot be redeemed for cash;
* cannot be exchanged for cryptocurrency;
* cannot be redeemed for goods, services or prizes having real-world monetary value;
* cannot be sold to another person; and
* have no value outside MahjOn.
Purchasing Coins grants you a limited, personal, revocable license to use those Coins within the Service in accordance with these Terms.
You do not acquire ownership rights in Coins.
3. No Real-Money Gambling or Cash Prizes
MahjOn is intended to operate as an entertainment game using closed-loop virtual Coins.
TJAM Studios does not provide:
* cash wagering;
* cash withdrawals;
* cash prizes;
* real-money jackpots;
* redemption of Coins for money;
* redemption of Coins for real-world prizes; or
* user-to-user cash settlement through the Service.
Users must not independently buy, sell or exchange MahjOn Coins for money or anything having monetary value.
Any such arrangement between users is unauthorized and outside the Service.
We may suspend or terminate accounts involved in unauthorized Coin trading or real-money settlement.
Availability of the Service may be restricted in locations where its operation is prohibited or requires regulatory authorization.
4. Eligibility
You must have the legal capacity required under applicable law to agree to these Terms.
You must not access the Service if:
* applicable law prohibits you from doing so;
* you have previously been permanently banned from the Service; or
* you are using the Service for unlawful purposes.
Where parental or guardian consent is legally required, you may use the Service only after obtaining that consent.
5. Accounts
You may be required to create an account.
You agree to provide accurate information and maintain the security of your account.
You are responsible for activity occurring through your account unless caused by a security failure attributable to us.
You must not:
* sell your account;
* transfer your account;
* share account credentials for commercial purposes;
* impersonate another person;
* create accounts using false information; or
* create multiple accounts for the purpose of exploiting rewards or promotions.
6. Gameplay and Scoring
MahjOn games are scored according to the scoring rules and game logic implemented in the Service.
The app’s server records will normally be treated as the authoritative record for:
* game actions;
* game results;
* scores;
* Coin deductions;
* Coin rewards;
* referrals;
* bonuses; and
* Coin balances.
We may correct an obvious technical or accounting error.
7. Entry Coins and Game Pools
Certain game modes may require users to commit a specified number of Coins to participate.
Coins committed to a game may form an in-game Coin pool.
Following completion of the game, the applicable Coin pool may be distributed according to the game’s MahjOn scoring and reward rules.
A portion of the Coin pool may be deducted by the platform as an in-game platform fee, rake or Coin sink.
The amount required to participate, applicable Coin deduction and potential Coin distribution will be displayed or otherwise made available through the Service.
All such amounts are denominated exclusively in virtual Coins and have no cash-equivalent redemption value.
8. Virtual Coin Purchases
MahjOn may offer Coin packages as consumable in-app purchases.
Purchases made through Apple are processed by the Apple App Store.
Purchases made through Android distribution may be processed by Google Play Billing or another permitted app-store billing mechanism where applicable.
Prices may vary by:
* country;
* currency;
* platform;
* taxes;
* promotions; and
* app-store pricing rules.
We may modify the price or quantity of future Coin packages.
Changes will not retrospectively alter a completed purchase.
9. Refunds
Except where required by applicable law, payments made for consumable virtual Coins are generally final after the Coins have been credited or consumed.
Refund requests for transactions processed through Apple or Google may also be governed by the applicable platform’s refund policies.
If a payment is refunded, reversed, charged back or otherwise cancelled after Coins were credited, we may:
* deduct corresponding Coins;
* reverse benefits obtained using those Coins; or
* restrict the account if necessary to prevent abuse.
10. Welcome Bonuses
New users may receive promotional Coins when creating an account.
The quantity, eligibility and availability of welcome bonuses may change.
Promotional Coins:
* are provided without cash value;
* may be subject to promotional conditions; and
* cannot be exchanged for money.
11. Referral Program
MahjOn may allow users to invite other users.
A referral reward may be provided when specified referral requirements are successfully completed.
We may determine:
* referral eligibility;
* reward amount;
* qualifying actions;
* campaign periods; and
* maximum referral rewards.
Users must not:
* refer themselves;
* create fake accounts;
* use bots or automated registrations;
* purchase fraudulent installs;
* manipulate referral attribution; or
* otherwise abuse the referral system.
We may reverse referral rewards obtained through abuse or fraud.
12. Promotional and Daily Bonuses
TJAM Studios may provide:
* daily login bonuses;
* promotional Coin drops;
* targeted offers;
* inactivity rewards;
* bankruptcy-relief Coins;
* special-event rewards; or
* other promotional benefits.
Promotions may be limited by:
* account;
* device;
* location;
* time;
* eligibility;
* campaign;
* usage history; or
* other disclosed criteria.
Promotional Coins are not cash and cannot be redeemed for monetary value.
13. Private and Invite-Based Games
Users may be able to create private games and invite other users.
The host may be allowed to choose certain gameplay settings, including available Coin entry levels.
Users must not use private games to:
* sell Coins;
* transfer Coins for consideration;
* launder or manipulate Coin balances;
* collude to artificially transfer Coins;
* coordinate real-world payments;
* manipulate rankings or scores; or
* circumvent Service restrictions.
We may monitor game patterns and restrict accounts where there is evidence of collusion, Coin dumping, fraud or abuse.
14. Fair Play
You must not:
* cheat;
* exploit bugs;
* use unauthorized software;
* use bots or automation;
* interfere with game communications;
* manipulate game outcomes;
* collude with other players;
* reverse engineer game systems for cheating;
* manipulate virtual Coin balances;
* abuse promotions;
* perform fraudulent purchases; or
* intentionally exploit an error in the Service.
Where we reasonably detect such activity, we may:
* cancel a game;
* reverse affected Coins;
* remove improperly obtained Coins;
* temporarily suspend an account;
* permanently terminate an account; or
* take other reasonable action to protect users and the Service.
15. Connectivity and Interrupted Games
MahjOn requires compatible hardware, software and network connectivity.
Game interruptions may occur due to:
* poor internet connectivity;
* device failure;
* server interruption;
* operating-system behaviour;
* app termination; or
* events outside our reasonable control.
We may implement rules governing disconnected games, abandoned games and interrupted matches.
Where technically feasible, we may restore, reverse or otherwise resolve affected Coin transactions in accordance with our system records.
16. Modifications to the Coin Economy
To maintain gameplay balance, security and sustainability, we may modify:
* game entry requirements;
* Coin rewards;
* promotional rewards;
* future Coin package prices;
* referral bonuses;
* daily rewards;
* platform Coin deductions;
* game modes; and
* other economy parameters.
Material changes affecting users will be communicated where required.
Purchased Coins already credited to an account will remain subject to these Terms.
17. Intellectual Property
MahjOn, including its:
* software;
* artwork;
* user interface;
* game design;
* graphics;
* sounds;
* logos;
* text;
* databases; and
* other content
is owned by or licensed to TJAM Studios and is protected by applicable intellectual-property laws.
These Terms provide only a limited right to use the Service for personal, non-commercial purposes.
18. User Conduct
You must not use MahjOn to:
* harass or threaten another person;
* transmit unlawful content;
* engage in fraud;
* promote illegal gambling;
* arrange real-money settlements;
* infringe intellectual-property rights;
* attempt unauthorized access to systems;
* distribute malicious software; or
* otherwise violate applicable law.
19. Suspension and Termination
We may temporarily restrict, suspend or terminate access where reasonably necessary because of:
* violation of these Terms;
* fraud;
* cheating;
* Coin manipulation;
* payment fraud;
* abusive conduct;
* security threats;
* legal requirements; or
* serious risk to the Service or other users.
Where appropriate and legally required, users may be given an opportunity to contact support regarding enforcement actions.
20. Account Deletion
You may request deletion of your account through the account-deletion mechanism provided by the Service.
Deleting your account may permanently remove:
* your profile;
* gameplay history;
* ranking;
* virtual Coin balance;
* purchased but unused Coins;
* promotional Coins;
* referral rewards; and
* other account benefits.
Deletion generally cannot be reversed.
21. Third-Party Platforms
Your use of MahjOn may also be subject to the terms of third parties such as:
* Apple;
* Google;
* app stores;
* authentication providers; and
* other technology providers.
TJAM Studios does not control those third-party services.
22. Disclaimer
The Service is provided on an “as available” basis to the extent permitted by applicable law.
We do not guarantee that:
* the Service will always be available;
* gameplay will always be uninterrupted;
* the Service will be error-free; or
* every device or network configuration will be supported.
Nothing in these Terms excludes consumer rights that cannot legally be excluded.
23. Limitation of Liability
To the maximum extent permitted by applicable law, TJAM Studios will not be liable for indirect, incidental, special or consequential losses arising from use of the Service.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
24. Indemnity
To the extent permitted by applicable law, you agree to indemnify TJAM Studios against claims, losses or expenses arising from your deliberate unlawful use of the Service or material violation of these Terms.
25. Changes to the Service or Terms
We may update the Service or these Terms from time to time.
Where an update materially affects user rights or obligations, we will provide notice where required by law.
Continued use after updated Terms become effective constitutes acceptance where legally permitted.
26. Governing Law and Jurisdiction
These Terms are governed by the laws of India, subject to any mandatory consumer-protection rights applicable to you.
Subject to applicable law, courts located in [CITY, STATE, INDIA] will have jurisdiction over disputes arising from these Terms.
